So , I have bid for an item with a non reserve price .
I won the item and the conformation e-mail :

So what happens now? ``
then another one in wich i was informed that I HAVE TO ARRANGE THE PICKING :

Please contact the seller to arrange the pickup. After you've picked up your order, the payment will be transferred to the seller.
We suggest that you arrange the pickup with the seller as soon as possible to avoid any issues.

All good till now , I was sending a message to the seller to arrange the picking and he replied to me as it follows :

Je vous informe que j'ai annulé la vente de ce miroir étant donné qu'il n'a pas obtenu le prix que j'en attendais. En effet ce miroir à une valeur de 3500 euros alors que Catawiki l'a vendu à 45 euros ce qui est une véritable escroquerie de la part de Catawiki. Donc, je vous prie de demander le remboursement de Catawiki.

So now we found out that NO RESERVE PRICE CAN BE CANCELED by the seller wich is against CATAWIKI policy .
I have called the cusomer care and ask for the clarifications on 9th of august and I got amazed by their reply in wich they said that the order was canceled becouse I did not replied to my emails where they have informed me that the seller cannot arrange the shipment so the transaction can be canceled .

We are sorry to inform you that the seller hasn’t shipped the lot yet.
We have tried to work with the seller and asked him several times to ship the lot. Unfortunately the seller doesn’t want to cooperate. Catawiki is an online platform which facilitates transactions between international sellers and buyers. Since the purchase agreement was made directly with the seller we’re not in a position to get the item shipped to you. We apologise for any inconvenience caused.
To resolve this matter we suggest to cancel the sale. Of course we won’t charge you any commission fees.
If you do not wish to cancel the sale and wish to receive the lot, we recommend you to take legal action against the seller. In this case you will need to contact the seller directly via your Catawiki account whilst logged in by following the steps below:
1. Click your username in the top right hand corner of our website
2. Select ‘My Purchases’ from the drop down menu
3. Your list of lots is displayed, click on the correct lot link to display the order page for that sale
4. Click on the ‘Send Message’ link to message the seller
Please let us know before 09/08 if you wish to proceed with the cancellation of the sale. If we do not hear from you we will proceed with the cancellation so that your payment can be refunded. We are still postponing your payment to the seller until further notice.

The email has no legal subject of canceling as it was clear from the start that THE SHIPMENT WAS THE BUYER`S DUTY .
Me as buyer i did my duty for honoring the payment as my funds were debited from my account . Catawiki kept my funds and still doing it .
When I called the customer care service they even did not had the decency to admit that they were tring to confuse me in sending an email with a completely out of the matter subject and then YET blaming me that i did not reply to the e-mail .
I passed the phone to my lawyer to have a direct legal discussion and to resume that :
1 . the buyer won an item withhout the reserve price .
2. as per catawiki policy ANY items won without the reserve price has to be sold at that price and CANNOT be cancceled .
3 . the buyer payed the product and catawiki confirmed the payment 4. a clear email has beeen sent from CATAWIKI to stand that the buyer has to arrange the shipment .
5. catawiki DID not use all the matters of comunications to get in contact and solve THEIR issue . They just sent email .
This is an abuse of trust and money ! I hope you will realize the agravate errors and solve this issue amicably before acting according to the provisions of the law .
