"SOS: UKW2917 Order was confirmed (on 22 03 2017) and was on it's way.\r\nToday 07 04 2017 the above order is still on it's way. It looks like that, between DS Music and Avid; lost its way. Now the cancellation of the order is on it's way...." Three months later (27/07/2017 JUL 10, 2017 | dsmusic replied: Dear Leslie. We can not understand which part of the email is your reply and what is previous messages pasted within. Regardless of this our last email stands and is our final response in regards to this matter – if you would like to take us up on our gesture of goodwill offer please lest us know: ///////////////////////// Dear Jon, With reference to your above email and query “… what is previous messages pasted within”, these are emails which I received from you DS Music and others in connection with this matter. If you do not communicate via email, with each-other, don’t involve the customer to trace the progress of the job for you. Lately, in your email letters you emphasize: “we can not understand…etc. ” Now let me tell you what I (the customer) do not understand: Why are you (DS Music) still today offering above, ignoring the £274.80 purchase price paid for UKW2917 ordered on 22/03/2017 and cashed the same day? In my numerous email letters from 03/04 to 23/07/2017 the main subject was and is today the failure of fulfilment of the confirmed UKW2917 ordered on 22/03/2017. In reply to my numerous order cancellations, each time you quoted DS Return Policy and refuse to accept the failures. Please see the TEXT of the AVID attachment notifications sent in my last email 10/07/2017. Could it be that you did not receive them, or did not look at them? 1.(31 03 2017 - Product not yet downloaded; you have no product on this account). Avid Master Account. 2.(16 05 2017 - Product not yet downloaded; you have no product on this account). Avid Master Account. 3. (See Return of consignment sent back on 03 05 2017). So Jon, let us be fair. Tell me what product, software, part of software, have I got after three months to justify you continuing to hold my £274.80 paid up front on 22/03/17, let alone the confirmed UKW2917 order? What upgrades/support could I expect for 1 year? What customer services did I have during the three months? What rating would you give for yourself? For what did I pay DS Music £274.80? For a cardboard box labelled Sibelius 8.5 academic for Students and Teachers, containing an invalid, useless download code? Jon, do you realize that the £274.80 you made (not earned!) could be more than an adult music student’s monthly allowance, or a retired music lover’s weekly pension, (at the age of 91)? Finally, I refer to your email above: ”if you would like to take us up on our gesture of goodwill offer please let us know.” Jon, if I would accept your ‘gesture of good will’ offer as per your manually adjusted Invoice #D97, as a matter of fact the price of ‘reinstatement’ version of Sibelius 8.5 upgrade would not be £143.04 but £417.84. Sorry Jon, the deal is off. My reply: No offer is acceptable which ignores the £274.80 already paid. What I quoted to you in my email on 29/05/2017 applies …. . The following is a quote from the email I received on 16/05/17 from identit-e Customer Service “ …. However, if this offer fails, alternatively, as per AVID policy: You may use this EDU-SIBAX209-XP6712825-422S56 Conversion Promotion Code to apply the academic version purchase price to a professional license at: http://shop.avid.com/ccrz_ProductDetailssku=SBDYNA 1000&isCSRFlow=true&portalUser=&store=shop Conversion Promotion Code: SIBREJ-BRWBJ01 – Use this code within one month. Contact the reseller from which you purchased your product. Be aware, reseller software return policies vary”. ---------------------------- If the above is applicable, I would buy the Digital 8.5 ‘Instant Download’ if possible on DVD, at £550.00 minus the £274.80, which you are holding from me on DS Music account. If not, I expect the full refund of the £274.80 within 5 working days, otherwise I have no choice but to turn to the Section 75 Consumer Credit Security Act 75. Regards, Leslie. P.S.: Jon, on 31/05/2017 10:58, although you knew that I would be away for a month and would not have access to internet connection, you sent me from your Personal: customerservices@dsmusic. com (DM post) an ‘Order UKW2917 confirmed’ notification: “ Hi Leslie, we're getting your order ready to be shipped. Hi, we checked and your order was dispatched on the same day the order was placed. Our 'saver delivery was selected and this usually takes 2-3 days although its not a guaranteed 2-3 days service. For the future we do have faster delivery options available including a guaranteed next day. Best Wishes, Jon
