After contacting the CEO, one of the Deputies investigated my case, please see Previous Review a Month Ago, about car accident at Cross Roads. Most insurance Companies appear to have dispensed with legaly qualified and Accident Investigation qualified Staff for Cost Cutting Reasons, therefore CLAIMS HANDLERS are simply experienced in Processing paperwork from the IN tray to the Out Tray? Just like the DWP and PIP Claims, when they're not medically qualified to understand the evidence infront of them, to make a well informed Discission. If you complain about a 50/50 split because your innocent? They have to get an independant assesment done to Explain the Evidence you have provided them. In my case the independant Assesment proved I was totaly innocent and the other party were solely At Fault for coursing the accident. "PHEW", after 34 years no accidents and Claims I am still innocent of coursing this accident, otherwise I would have been shafted with a 50/50 or 75/25 Liability. Also you are not provided with a copy of the other parties "Statement of truth", so how can you defend your self against their False Misleading Accusations and Lies? The Answer is let Aviva make their initial descission, make a Complaint and state that you don't agree with their descission. Then Request a "SAR", Subject Access Request, for all the Evidence etc they have on your case. This should include a copy of the Otherparties "Statement of Truth". When they review their descission and state it is final, you are entitled to Complain and Raise a case with the Financial Ombudsman, Doo So Imediately as there is a 4 month waiting list? Once you have the other parties "Statement of Truth", youl identify who their claims Handler is? Check on line, and their Reviews to see what your up against. Usualy they are independant "Credit Hire Companies who supply expensive hire cars as part of their ACCIDENT CLAIMS MANAGEMENT SERVICES. Read through the Stateme of Truth, (Work of Fiction) and take it sentence by sentence and give your Responce / Comment on their Acusations against you. Go through the accident stage by Stage as it occurred, Detail by Detail. Always respond to each Accusation and give the Truth otherwise if you don't challenge it, the Court will assume you have accepted their false misleading accusations, as the TRUTH. Produce a copy for the ombudsman, one spare copy for your own Folder, and Email off or post one copy to AVIVA. if aviva don't accept it or win your case, the ombudsman is in Waiting to Review their Behaviour at a Later date? Aviva should change their descission and hold the other party "At Fault for coursing the accident, and forward it to their Recovery Dept. ALWAYS WORK WITH Aviva, and be prepared to go to court to Help them Claim off the Other Party. NEVER ACCEPT LIABILITY if your sure your Inocent and did not course the Accident. PLEASE NOTE: you can only be issued a 50/50 or 75/25 Liability against you by your insurence company, if the other party has Provided Indesputable Evidence that proves, "Beyond All Reasonable Doubt"that you did something that contributed to coursing the Accident! THATS WHY YOU NEED to request the "SAR", To see what Evidence they have provided against you. Most Likely there is No Sutch Evidence! So, your insurence company cannot Settle the claim Quickly by Wrongly accusing you of coursing the accident. Remember "You are Innocent untill Proven Guilty". Please note thease "CHC Claims Managment Companies" will pursue costs and Their own Car Hire Charges from their Client if they loose their case ???? Its in the T&C's in their Contract Agreements. My advise is always go Direct to your "Insurence Underwritter", not a Claims Handler.

After 34 years of no Accident no claims, I drove My Vauxhall Zafira through a crossroads with the Right of way. When a young lady approached from the Minor Side Road with Stop Markings requiring her to "Stop and Give way to Priority Traffic with the Right of Way", ME ? Unfortunately, with her 3 months of driving experience since passing her driving test, her independent Claims handler as, (3rd party insurance), "REFUSES to accept LIABILITY", I've pointed out to my Insurance "Aviva", the Road Traffic Act 1988 section 3, 32a (2). S36. Highway code section 176, 171 and 172. While providing pictures of the vehicles in position at the Junction after the Incident. However, the first reply I got was a 50/50 liability. I refused to Admit Liability for an accident that was not my fault. It is now in the hands of the Aviva "Customer Care Team" to Review in about 6 weeks' time? In the meantime, my insurance Broker? Intermediary, Grove and Dean, has informed me my renewal Invitation from Aviva has not been forth coming? to renew my Aviva Insurance by the end of July 2023. Yours, M. Burton.

I was driving around Tescos Main Entry Exit Ring Road (car park). At March in Cambridgeshire when a young lady driving from 9ne parking area to another, Failed to stop at the Cross Road Junction, as she was on the Minor road and faced white lines at the Junction requiring her to stop and give way to me, who has Priority. Initially my brocker refers me to a Handler K???????s, who simply process the claim and charge my insurence company for their services, 7nfortunately most of these Independant Claims Handlers don't have their own Legal Team, So the Incompetance was Unbelievable. I called Aviva as my insurence Underighter and they agreed to take over the claim. Great success and my car was not writtern off? Unlike what K???????s tried to doo, so their Friends at Car Port could Auction off my car as a Repairer. Needless to say I refused to hand it over as NO VALUATION had been agreed at the time. Aviva were quick to view my Pictures and Corespondece I emailed through and on the link they sent, and Quick to get my car in for Inspection and agreed it was Financialy Viable to repair my Car. However the Other Third Party, I Believe is using one of thease independant Claims handlers who simply keeps Frustrating and Delaying Liability so they can invoice her insurence company as mutch as they can Drag it out. Then they will dump her and tell her to claim Compensation from her insurence company or simply refer her to her Underwritting Insurer to clear up the mess with their Legal Team. Absolute scerge thease independant claims handlers !!!! So Aviva contacted me and said because the lady failed to stop on a Minor Road at the Juntion with marked lines and drove straight across the Main Road at the Cross roads Roads infront of us? With us having Priority? We recieved a letter today saying they would find it hard to settle the claim and consider 50/50 Liability. I pointed out the responsibility of the other partyand their responsibility to, Driving With Due Care and Attention (RTA 1988 SECTION 3, 3ZA (2). S36 RTA 1988 SECTION 176 HIGHWAY CODE. AND Highway Code Section / Rule 171 & 172. I also informed them under no Circumstances would I accept partial or full Liability for some one else failing to stop at a Junction and Driving into my car. The Nice Lady on the 0800 051 2503 said she would Review the d3scission on letter dated 23rd May 2023, which arrived on the 30th? The last of 7 days limit to reply too from the 23rd? Usualy you get 14 days to recieve the letter, collect and prepare the Evidence/ Info to send in, so 7 days isn't realy the answer. I now await a reply from Aviva when they have reviewed all the Evidence next week, Google maps of the Accident area,Mobile Phone Pictures of the vehicles in position at the accident etc on the 21st Feb 2023. I ronicaly all the Substancial Evidence the Other Party has to justify blaming me for the accident is the young Ladies "Statement of Truth". My car is being repaired and we look forward to its return. SO OK so far? no problem contacting Aviva to talk to some one.

I was involved in a car accident that was absolutely in no way my fault but the other driver claimed that it was! Nightmare! It resulted in a 21 month wait to get to court. Communication only really started when a legal firm got in touch a couple of months before the court case to prepare. There was very little communication from Aviva prior to this. Do yourself the biggest favour possible and use a dash cam as it could save you no end of hassle. I was told prior to going into the court room that the onus was on our side to prove the case but not to hold out much hope of that happening. Despite this I was fully vindicated by a very good judge and was also helped by a less than impressive cobbled together case against me.

After being with Aviva for a few years i was a little dissapointed to find another insurer £350 cheaper & after speaking with Aviva being told I'm better off switching to another provider! No accidents or convictions yet my policy grew quicker than a sun flower in summer!
