Stimate client, Vă mulțumim pentru feedback. Înțelegem dezamăgirea dumneavoastră, în special în ceea ce privește durata procedurii, valoarea obținută și comisionul aplicat. Dorim însă să clarificăm că valoarea despăgubirii nu este stabilită de AirAdvisor, ci de legislația aplicabilă și de circumstanțele concrete ale zborului. În cazul dumneavoastră, suma standard de 400 EUR a fost stabilită în funcție de distanța zborului și de drepturile prevăzute de Regulamentul UE 261/2004. În ceea ce privește comisionul, cazul dumneavoastră a ajuns în etapa juridică, ceea ce implică costuri suplimentare pentru serviciile avocaților și pentru acțiunile legale necesare. Din acest motiv, conform condițiilor aplicabile, comisionul pentru etapa judiciară este de 50%, spre deosebire de comisionul standard din etapa precontencioasă. De asemenea, procedura a durat mai mult deoarece cazul a necesitat intervenție juridică și parcurgerea unor proceduri complexe, ale căror termene depind și de compania aeriană și de autoritățile/instanțele implicate. Înțelegem că așteptarea și comunicarea generală pe parcursul unei proceduri îndelungate pot fi frustrante. Ne pare rău că experiența dumneavoastră nu a fost la nivelul așteptărilor și vă mulțumim că ne-ați transmis feedbackul. Cu respect, Echipa AirAdvisor

Gostaríamos, no entanto, de esclarecer que a comissão de 50% é aplicável quando o processo requer intervenção jurídica, uma vez que, nessa fase, o caso é encaminhado para advogados e envolve custos legais e outros procedimentos adicionais para tentar obter a indemnização. A nossa comissão não é simplesmente aplicada de forma arbitrária: depende da fase em que o processo se encontra e dos serviços necessários para prosseguir com a reclamação. Quando um caso é resolvido na fase inicial, aplica-se a comissão correspondente a essa etapa. Quando é necessário recorrer à via judicial e envolver advogados, a comissão é ajustada para refletir os custos e o trabalho adicional envolvidos. Compreendemos que receber menos do que esperava possa ser dececionante, mas o nosso objetivo é assumir o processo e os custos associados à sua gestão e intervenção jurídica, sem exigir um pagamento antecipado pelos nossos serviços. “I have been unable to complete the claim on the website as it won’t accept the uploads. It’s been frustrating. In addition, one message said the window for completing the claim has been closed! How can that be; I only just received my luggage yesterday.”
